Raffle Terms & Conditions
1. Promoter and Beneficiary
Each raffle listed for sale on this website (a "Raffle") is conducted by Code Purple Refuge Limited (ABN 16 677 509 812) of PO Box 187, Werribee, VIC 3030 ("the Promoter"), via its nominee, David Kirby. The Promoter is a not-for-profit organisation registered as a charity with the Australian Charities and Not-for-profits Commission (ACNC). Code Purple Refuge Limited is the sole benefiting organisation of all net Raffle proceeds.
2. Eligibility
Entry is open only to individuals aged 18 years or over who are residents of Victoria, New South Wales or Queensland at the time of entry. Entry is not open to residents of Western Australia, South Australia, Tasmania, the Australian Capital Territory or the Northern Territory. By purchasing a ticket, you confirm you meet this eligibility criteria. Orders identified as originating from an ineligible state or territory will not be treated as valid entries and will be cancelled and refunded.
3. Tickets
The ticket price, the total number of tickets available, and any bonus or free ticket policy for a given Raffle (none apply unless expressly stated) are set out on that Raffle's product listing. Each ticket purchased is assigned a sequential ticket number once your order is confirmed as paid. This number is recorded in the Promoter's records and will match the number provided to you in your ticket confirmation email. There is no limit on the number of tickets a person may purchase, subject to availability.
4. Minimum Ticket Threshold and Cancellation for Insufficient Uptake
For each Raffle, the Promoter may set a minimum number of tickets that must be sold by the stated closing date for that Raffle to proceed (the "Minimum Threshold"), as shown on the relevant Raffle's product listing. If the Minimum Threshold is not reached by the closing date, the Promoter reserves the right, at its sole discretion, to cancel that Raffle.
If a Raffle is cancelled under this clause:
- every ticket purchaser will be notified by email;
- every ticket purchaser will receive a full refund of the ticket price paid, processed to the original payment method, with no action required on the purchaser's part;
- no draw will be conducted for that Raffle.
This clause exists so that Raffle proceeds are not outweighed by prize and administration costs where public uptake is low. It applies in addition to (not instead of) the Promoter's general right to cancel or postpone a Raffle for reasons outside its reasonable control (for example, technical failure, suspected fraud, or force majeure), in which case the same notification and full-refund process applies.
5. Closing Date, Draw and Location
The closing date, draw date, draw method and location are stated on the relevant Raffle's product listing and ticket confirmation. If all available tickets sell out before the stated closing date, the Promoter may bring the draw forward; entrants will be notified via the Raffle's results page if this occurs. Every ticket has an equal and random chance of being drawn. Where a Raffle has more than one prize, the most valuable prize is drawn first, with each subsequent prize drawn in descending order of value. A ticket that has already been drawn is not eligible to be drawn again. No book-buyer's prize is offered.
6. Prizes
A description and retail value of each prize is stated on the relevant Raffle's product listing. Prizes are not transferable or exchangeable for cash, except at the Promoter's sole discretion. Prizes will be delivered to the winner within 28 days of the draw.
7. Winner Notification and Unclaimed Prizes
Winners are notified by phone and/or email, and results are published at the location stated on the relevant Raffle's product listing. If a winner cannot be identified or located, or does not wish to accept a prize, the Promoter will retain the prize (or, for perishable or livestock prizes, sell it and retain the net proceeds) for 12 months from the draw date. After 12 months, an unclaimed prize (or its sale proceeds) will be disposed of in accordance with the requirements of the permit/declaration governing that Raffle.
8. Authorisation
Raffles conducted by the Promoter are authorised under its Victorian Declaration as a Community/Charitable Organisation, number 63219 (Victorian Gambling and Casino Control Commission). Where a Raffle's ticket sales fall under the applicable registration-free thresholds in New South Wales and Queensland, no separate permit is required in those states; the specific permit/authorisation position for a given Raffle is stated on its product listing.
9. Privacy
Personal information collected during ticket purchase (name, address, phone number, email) is used only to conduct the Raffle, including verifying eligibility, assigning and confirming ticket numbers, and contacting winners. It will not be used for unrelated marketing without your separate consent, and is retained only as long as required by applicable raffle recordkeeping obligations (a minimum of three years).
10. Complaints
Any questions or complaints about a Raffle can be directed to Code Purple Refuge Limited via our contact page or the contact details on the relevant Raffle's product listing.
11. General
The Promoter's decision in relation to any aspect of a Raffle, including the conduct of the draw, is final. These Terms and Conditions apply to every Raffle conducted by the Promoter unless a specific Raffle's listing states otherwise.
